Terms of Service

Welcome to Bahimi. These Terms of Service ("Terms") govern your access to and use of the Bahimi website at bahimi.com (the "Site") and any purchases you make from us. By accessing the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

1. Who We Are

The Site and the Bahimi brand are operated by Bandana Capital LLC ("Bahimi," "we," "us," or "our"), a company based in Chicago, Illinois, USA. You can reach us anytime at customerservice@bahimi.com.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order. By using the Site, you confirm that you meet this requirement and that the information you provide is accurate and complete.

3. Your Account

You may be able to create an account to make checkout faster and track orders. You are responsible for keeping your account credentials confidential and for all activity under your account. Please notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

4. Products, Descriptions, and Availability

We work to display our products, colors, and details as accurately as possible. However, we cannot guarantee that your screen's display of any color is accurate, and product images are for illustration. All products are subject to availability, and we may limit quantities, discontinue items, or change product details at any time without notice.

5. Pricing and Errors

All prices are shown in the currency indicated at checkout and are subject to change without notice. Despite our best efforts, a product may occasionally be mispriced or described in error. If we discover an error affecting an order you've placed, we may correct the price, cancel the order, or contact you for instructions before shipping. If we cancel an order that has already been paid, we will issue a full refund.

6. Orders and Acceptance

Your order is an offer to purchase. We reserve the right to accept or decline any order for any reason, including suspected fraud, errors, or stock limitations. A confirmation email acknowledges that we received your order; a contract of sale is formed only when we dispatch the items. If we cancel an order after payment, you will receive a full refund.

7. Payment

Payment is processed at checkout through our payment providers. By submitting an order, you represent that you are authorized to use the payment method provided. You authorize us (and our payment processors) to charge the total order amount, including taxes and any applicable shipping, to that method.

8. Promotions and Discount Codes

From time to time we offer promotions, including a 20% discount on orders of 4 or more pieces and free standard shipping on orders over $150. Unless stated otherwise:

• Promotions cannot be combined with other offers.
• Promotions are subject to change or withdrawal at any time.
• If a return causes an order to no longer qualify for a quantity-based discount or free-shipping threshold, your refund will be adjusted as described in our Return & Refund Policy.

9. Shipping and Delivery

Shipping options, timeframes, and costs are presented at checkout and detailed in our Shipping Policy. Title and risk of loss pass to you upon delivery to the carrier. Delivery estimates are not guaranteed, and we are not responsible for carrier delays outside our control.

10. Returns and Refunds

Returns, refunds, exchanges, and your rights as a consumer are governed by our Return & Refund Policy, which is incorporated into these Terms by reference. Please review it before purchasing.

11. Intellectual Property

The Site and all of its content — including the Bahimi name and logo, text, graphics, images, product designs, and the overall look and feel — are owned by or licensed to us and are protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the Site without our prior written permission.

12. User Content and Submissions

If you post reviews, comments, photos, or other content, or tag us on social media, you grant Bahimi a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content in connection with our marketing and operations. Before featuring content you've shared on social media, we will seek your permission. You represent that you own or have the rights to any content you submit and that it does not violate the rights of any third party. We may remove content at our discretion.

13. Prohibited Uses

You agree not to use the Site to: violate any law; infringe our or others' intellectual property; transmit malware or interfere with the Site's operation; attempt to gain unauthorized access to our systems; scrape or harvest data; or engage in fraudulent activity, including abusive or fraudulent return behavior.

14. Third-Party Links and Services

The Site may link to or rely on third-party websites and services (such as payment processors and shipping carriers). We are not responsible for the content, policies, or practices of those third parties, and your use of them is at your own risk.

15. Disclaimers

The Site and products are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Some jurisdictions do not allow certain disclaimers, so some of these may not apply to you, and nothing here limits any non-excludable statutory rights you have as a consumer.

16. Limitation of Liability

To the fullest extent permitted by law, Bahimi and its owners, employees, and partners will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or products. Our total liability for any claim relating to a product will not exceed the amount you paid for that product. Nothing in these Terms excludes liability that cannot lawfully be excluded.

17. Indemnification

You agree to indemnify and hold harmless Bahimi and its owners, employees, and partners from any claims, losses, or expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Site.

18. Governing Law

These Terms are governed by the laws of the State of Illinois, USA, without regard to its conflict-of-laws rules. Nothing in this section deprives you of the protection of mandatory consumer laws in your country of residence.

19. Dispute Resolution

We hope to resolve any concern informally first — please contact us at customerservice@bahimi.com before taking any formal action. Any dispute that cannot be resolved informally and that is not subject to mandatory local consumer law will be resolved in the state or federal courts located in Cook County, Illinois, and you consent to their jurisdiction.

20. International Use and Consumer Rights

We currently sell to customers in the United States and Canada. We are working toward serving the United Kingdom and European Union, and these Terms will be updated to reflect the statutory rights that apply to those consumers when we launch there. You are responsible for complying with the laws of your jurisdiction. Nothing in these Terms deprives you of any mandatory consumer protections that apply to you.

21. SMS and Mobile Messaging Terms

When you provide your mobile number and affirmatively opt in to receive text messages from Bahimi, you consent to receive recurring automated marketing and transactional text messages from Bahimi and Bandana Capital LLC at the mobile number you provided. Messages may include welcome messages, product or shopping reminders, browse, cart, and checkout reminders, back-in-stock notices, early-access or VIP offers, win-back messages, review or feedback requests, order confirmations, and other account or service-related communications. Consent to marketing text messages is not a condition of purchase.

Message frequency varies based on your interactions with Bahimi, the programs you join, and the transactions or requests you make. The number and timing of messages may change.

Message and data rates may apply. Your mobile carrier's rates and terms govern any charges. Carriers are not liable for delayed or undelivered messages.

Opting out: Reply STOP to any Bahimi marketing text to cancel. We may send one final message confirming your opt-out. You may also use other reasonable opt-out words or contact us at customerservice@bahimi.com. After opting out of marketing messages, you may still receive non-marketing messages that are necessary to complete or service an order, respond to a request, or otherwise fulfill a transaction, where permitted by law.

Help and support: Reply HELP for help or email customerservice@bahimi.com. Support is available through that email address for questions about the messaging program, consent, or opt-out status.

You represent that you are the subscriber or customary user of the mobile number you provide and that you are authorized to consent to receive messages at that number. If you change, deactivate, or transfer your number, please opt out or notify us before doing so.

We may modify, suspend, or discontinue the messaging program or change the sending number at any time. Your participation is also governed by our Privacy Policy, which explains how we collect, use, disclose, and protect personal information, including telephone numbers and messaging data.

22. Changes to These Terms

We may update these Terms from time to time. The current version will always be posted on this page with a "last updated" date. Changes apply to orders placed after the change is posted.

23. General

If any provision of these Terms is found unenforceable, the remaining provisions stay in effect. Our failure to enforce any provision is not a waiver of it. These Terms, together with our Return & Refund Policy, Shipping Policy, and Privacy Policy, make up the entire agreement between you and Bahimi regarding your use of the Site.
